The Law on Murder in Idaho
Under Idaho law, murder (called homicide) is defined as the unlawful killing of a human being. To be considered murder, the killing must have been intentional or have involved extreme and prologue pain.
Idaho considers two degrees of murder:
- First degree murder: This is the most serious charge. First degree murder is charged when the death allegedly involves things like poison, torture or vengeance. It is also charged when a police officer has been killed, or in other serious situations.
- Second degree murder: All other kinds of murder are of the second degree.
The penalties for a murder conviction are serious. Every person found guilty of murder of the first degree can be punished by death or life in prison. People found guilty of second degree murder can be punished by a minimum of ten years in prison and may face a life sentence as well.
Manslaughter is the unlawful killing of another without malice. I represent people accused of manslaughter, including voluntary manslaughter, involuntary manslaughter and vehicular manslaughter.
